Introduction

JobzAlly, the Consultant Engine is owned by JobzAlly, a company incorporated under the laws of India with company registration number (AKL/YAD/CE/0011/2023) and MSME - Udyog Aadhaar Number (UDYAM-KR-03-0346259) and having its registered office at #D6, Raghavendra Swamy Layout, Opposite to Guest Line Hotel, Yedavanahalli, Bengaluru – 562107, Karnataka, India. JobzAlly, hereinafter, referred to as the "Company". The terms “We”, “Us” or “Our” shall mean the “Company”.

Applicable Laws

These Terms and Conditions will be governed by and construed in accordance with Indian laws, and any disputes relating to the same will be subject to the non - exclusive jurisdiction of the Courts of Bengaluru, Karnataka, India.

Terms of Agreement

This Agreement is perpetual, and it is an electronic contract binding on the Users. This agreement shall be effective for the period as specified in the Customer Service Agreement Form. This agreement will be extended automatically for a further period of similar duration, unless otherwise specified or terminated by the Company or by the User through a written communication to the Company seeking withdrawal of services on or before at least 2 months from the date of expiry of the agreement. The Company will accordingly raise an invoice basis the prices of services prevailing at the time of extension/renewal of this agreement and all other terms and conditions of the agreement shall remain unchanged.

Confession (Acknowledgment)

The Terms and Conditions set out here below have to be read in consonance with the Privacy Policy and Disclaimer, which altogether regulate the use of the JobzAlly website.

All Users who access this website (www.jobzally.com) and/or mobile application agree and acknowledge that they have read and understood these Terms and Conditions, and agree to be bound by the same. Any User who disagrees shall not access this website.

“Users” of this website refer to Job Seekers, Referees, Employers, Recruitment Consultancies and Individual Consultants who access this website.

Availability

This website is designed for operating on specific operating systems. User should ensure that the users device is compatible and meets all necessary technical specifications to download, access and use the website. Company do not make any guarantee as to the on-going availability of the website. User agree and acknowledge that the company is not liable for any loss or damage incurs by not being able to access the website.

Registration on this Website

The Users are required to register their details with the JobzAlly website in order to enable JobzAlly to get the right person placed with the right firm.

All Users are required to provide the below mentioned details in common:

  • Name
  • Mobile Number
  • Phone Number
  • Email ID
  • Postal Address

User Specific Information

In addition to the above, user specific information has to be provided by each User as stated below:

  • Job Seekers to specify their educational details, internship & trainings undergone details, employment details, upload resume along with the aforementioned personal details.
  • Employers to specify their company GST and contact person details along with the aforementioned details. And also specify the Job Title, Designation, Experience Level, Location and Job Descriptions of the available vacancies.
  • Consultants to specify their company GST, industries for which they recruit and contact person details along with the aforementioned details. And also specify the Job Title, Designation, Experience Level, Location and Job Descriptions of the available vacancies.
  • Individual Consultants to specify their education and employment details if any along with the aforementioned personal details.

Scope of the Terms and Conditions

These Terms and Conditions, as modified and updated by the company periodically set out the guidelines for the use of this website.

If you access the website as a candidate, you shall be subject to the Terms of Use – Job Seekers.

If you access the website for an organization, you shall be subject to the Terms of Use – Employers.

If you access the website as a recruiter, you shall be subject to the Terms of Use – Recruitment Consultancies.

If you access the website as an individual recruiter, you shall be subject to the Terms of Use – Individual Consultant.

And along with the Terms & Conditions, the Privacy Policy that may be applicable to your activity on the website. You expressly give consent that by mere use of the website, you shall be contracting with the Company under these Terms of Use as applicable, which shall constitute your binding obligations with the Company.

Terms of Job Seekers

  • The Job Seeker, hereinafter, referred to as the "User".
  • The User may upload his/her resume, and update the same free of cost.
  • The User undertakes that the information/data provided by him/her is authentic and genuine.
  • The User shall check the authenticity of all or any response received pursuant to the resume or information being fed into the network system of the company by the User.
  • The User shall not use the website for commercial purposes, and upload multiple resumes.
  • The User may modify the information/data uploaded by him/her. However, he/she shall not feed fresh information of another person in the place of the information fed by him/her.
  • The User agrees and acknowledges that the said modifications made by him/her to the information/data will be updated on the Profile only after 24-48 hours of such change.
  • The User agrees and acknowledges that the company reserves the right to reject/delete any information/data fed by the User at its discretion in order to fit the Profile in its database.
  • The User represents that he/she is not a minor, and is not bound by any legal disability to comply with these Terms.
  • The User does not own any kind of Intellectual Property rights over the data/information uploaded by him/her.
  • The User should not pay any of the Employer, Recruitment Consultancies, Individual Consultants and JobzAlly team to get job as it is against to the Indian Laws.
  • The User agrees and acknowledges that payments, if any, made to Employers or Recruitment Consultancies or to the Individual Consultants are at his/her risk. Company assumes no responsibility for the same.
  • The User agrees and acknowledges that JobzAlly is only a facilitator for the Job Seekers, Referees, Employers, Recruitment Consultancies and Individual Consultants, and not their agents.
  • The User shall view and apply for the job vacancies or refer a PAL for the suitable job vacancies posted by the employers and recruitment consultancies. However the company do not take any responsibility if the User does not get to hear back from the respective job vacancy Employer and Consultants or stop being contacted or any false claims that either an Employer or Consultants or User makes during the process.
  • However the company do not take any responsibility if the User do not get any feedback from the Employers Recruitment Consultancies and Individual Consultants.

Terms of Employers

  • The Employer, hereinafter, referred to as the "User".
  • The User shall post/upload a job vacancy on the website only after signing all the necessary agreements as per the recruitment process.
  • The User agrees and acknowledges that JobzAlly is entitled to make amendments to the existing vacancy details in order to fit its database.
  • The User shall provide the appropriate email ID for vacancies posted on the website for responses.
  • The User should not mention their contact person name, contact number, Email ID and postal address in the job/brief description field provided at the website.
  • The User shall execute an undertaking stating that the jobs advertised on the website are genuine, and he/she is authorized to post the advertisement.
  • The User agrees and acknowledges that the company is not liable for any information received by him/her, and he/she assumes the responsibility to check the authenticity of the same.
  • The User agrees and acknowledges that the company shall make the best efforts to shortlist candidates on the basis of prescribed parameters. However, company is not solely responsible for the same.
  • The Employer has to post the job vacancies on a regular basis. So that the company can allocate a dedicated resource to close the requirements at the earliest.
  • The User does not own any kind of Intellectual Property rights over the data/information uploaded by him/her.
  • The User agrees and acknowledges that the company does not perform background checks/verifications on candidates applying for the jobs. The User shall carry out the necessary background check of the job seeker if required, and the Company assumes no liability for the same.
  • The User agrees and acknowledges that JobzAlly is only a facilitator for the Job Seekers, Referees, Employers, Recruitment Consultancies and Individual Consultants, and not their agents.
  • The User should not contact Job Seekers directly. Any kind of conversation between the Employer and the Job Seeker should be through the JobzAlly.
  • The User should not contact directly with the Recruitment Consultancies and Individual Consultants who have signed the necessary agreements with JobzAlly.
  • The User has to delete the job postings once the requirement is closed else User can inform verbally or send a mail to JobzAlly to delete the job postings once the requirement is closed.
  • --- Terms of Recruitment Consultancies

  • The Recruitment Consultancies, hereinafter, referred to as the "User".
  • The User shall only view the job vacancies posted by the Employers and other Recruitment Consultants; and not authorized to reuse or amendment the same.
  • The User shall view and refer Job Seekers for the suitable job vacancies posted by the Employers and other Recruitment Consultancies. However the company do not take any responsibility if the User do not get any feedback from the Employers and other Recruitment Consultancies.
  • The User shall post/upload a job vacancy on the website only after signing all the necessary agreements as per the recruitment process.
  • The User agrees and acknowledges that JobzAlly is entitled to make amendments to the existing vacancy details in order to fit its database.
  • The User shall provide the appropriate email ID for vacancies posted on the website for responses.
  • The User should not mention their contact person name, contact number, Email ID and postal address in the job/brief description field provided at the website.
  • The User shall execute an undertaking stating that the jobs advertised on the website are genuine, and he/she is authorized to post the advertisement.
  • The User agrees and acknowledges that the company is not liable for any information received by him/her, and he/she assumes the responsibility to check the authenticity of the same.
  • The User agrees and acknowledges that the company shall make the best efforts to shortlist candidates on the basis of prescribed parameters. However, company is not solely responsible for the same.
  • The User does not own any kind of Intellectual Property rights over the data/information uploaded by him/her.
  • The User shall co-ordinate with their respective Job Seekers on conducting of interviews till the end of selection process. The Company assumes no responsibility for the same.
  • The User agrees and acknowledges that the company does not perform background checks/verifications on candidates applying for the jobs. The User shall carry out the necessary background check of the job seeker if required, and the Company assumes no liability for the same.
  • The User shall maintain the confidentiality of the information provided by the Job Seeker, and shall not share the same with the third parties.
  • The User agrees and acknowledges that JobzAlly is only a facilitator for the Job Seekers, Referees, Employers, Recruitment Consultancies and Individual Consultants, and not their agents.
  • The User can exclusively work for the selected Employer’s requirements on a regular basis.
  • The User should not contact Employers directly. Any kind of conversation between the User and the Employer should be through the JobzAlly.
  • The User should not contact directly with the Employers, Other Recruitment Consultancies and Individual Consultants who have signed the necessary agreements with JobzAlly.
  • The User agrees and acknowledge that they will not approach the Employers who are member of the JobzAlly to sign the contract and become the customer of them.
  • The User has to delete the job postings once the requirement is closed else User can inform verbally or send a mail to JobzAlly to delete the job postings once the requirement is closed.

Terms of Individual Consultants

  • Job holder or a person working for an Employer is not supposed to register as an Individual Consultant. Only an unemployed person can register as an Individual Consultant.
  • The Individual Consultants, hereinafter, referred to as the "User".
  • The User shall only view the job vacancies posted by the Employers and Recruitment Consultants; and not authorized to reuse or amendment the same.
  • The User shall view and refer Job Seekers for the suitable job vacancies posted by the Employers and Recruitment Consultancies.
  • The User shall post/upload a job vacancy on the website only after signing all the necessary agreements as per the recruitment process.
  • The User agrees and acknowledges that JobzAlly is entitled to make amendments to the existing vacancy details in order to fit its database.
  • The User shall provide the appropriate email ID for vacancies posted on the website for responses.
  • The User should not mention their contact person name, contact number, Email ID and postal address in the job/brief description field provided at the website.

  • The User is solely responsible for the job description or any other details sent out to the Job Seekers, and company assumes no liability for the same.
  • The User agrees and acknowledges that the company is not liable for any information received by him/her, and he/she assumes the responsibility to check the authenticity of the same.
  • The User agrees and acknowledges that the company shall make the best efforts to shortlist candidates on the basis of prescribed parameters. However, company is not solely responsible for the same.
  • The User does not own any kind of Intellectual Property rights over the data/information uploaded by him/her.

Company’s Liability

JobzAlly is only an intermediary between the Users who intend to contact each other for the purposes of existing job vacancies and other services related to career options.

JobzAlly takes all reasonable measures to ensure that the details provided on this website are accurate. However, company assumes no liability for any erroneous information posted by any of the Users. Company also assumes no liability for the credentials of the prospective Employer, which are sent in the job mail to the User.

It is the sole responsibility of the Users to ensure that the information shared on the website is accurate and suits their requirements. The Users have to conduct appropriate background checks to ensure the genuinity and bonafideness of the said information. The company makes no representation or warranty with regard to the same.

Company does not warrant that the jobs sent in the job mail will be relevant to the profile.

Company also does not warrant a satisfactory response from the Employers on the resume of a User being uploaded.

Company further does not warrant that job emails will be sent to the Users on a daily basis.

Company is not liable for loss of any data technical or otherwise, or of the resume/ insertion or information/data or particulars supplied by User due to acts of god as well as reasons beyond its control like corruption of data or delay or failure to perform as a result of any cause(s) or conditions that are beyond Company’s control.

Use of the Website

Users agree and acknowledge that they shall access this website exclusively for their own purposes. Usage of the same for commercial purposes without obtaining a prior written consent from Company is prohibited.

The Users are prohibited from using this website in any way, which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

The User shall not attempt to gain unauthorized access to any portion or feature of the website, or any other systems or networks connected to the website or to any server, computer, network, or to any of the services offered on or through the website, by hacking, password "mining" or any other illegitimate means.

The User shall acknowledge and agree that we are not responsible for the use of any personal information that the User publicly disclose or share with others on the website. It is possible that other Users (including unauthorized users or "hackers") may post or transmit offensive or obscene materials on the website and that the User may be involuntarily exposed to such offensive and obscene materials. It also possible for others to obtain personal information about you due to the use of the website, and that the unauthorized users or hackers may use such information to harass or injure the Users. We do not approve or support such unauthorized uses.

The Users shall, at all times, comply with the requirements of the Information Technology Act, 2000 as also rules, regulations, guidelines, bye laws and notifications made there under, while posting any information on this website. They shall face all civil and criminal liabilities for non - compliance with the same.

Users agree and acknowledge that company may monitor and supervise the use of the website periodically to ensure that it is used in a lawful manner.

Changes to the Website, and the Terms and Conditions

The Company reserves the right to amend this website, and these Terms and Conditions at its sole discretion. Users are abound by such amendments, if any, and are required to regular checks to be updated of the same.

Waiver

In the event company fails to enforce the performance of any provision in these Terms and Conditions, the same shall not constitute a waiver of the right to subsequently enforce that provision or any other provision. Company reserves the right to subsequently enforce that provision.

Severability

In the event one or more of the provisions of these Terms and Conditions are found to be unlawful, invalid or otherwise unenforceable, the remainder of these Terms and Conditions shall be valid and enforceable.

Compliance with Laws

The Users agree and undertake that their use of the company website will comply with all applicable laws and regulations.

Indemnification

The Users shall keep company indemnified against any losses, damages, costs, liabilities and expenses incurred or suffered by company arising out of any breach of any of these terms and conditions, or arising out of any claim as a result of the breach of these Terms and Conditions.
